TyLinks VPN

1. The Service

TyLinks VPN provides a personal virtual private network (VPN) service using the WireGuard® protocol. The service is available at connect.tylinks.com and through our mobile application.

We offer access to VPN servers in multiple locations (currently Canada, United Kingdom, and United States). Server availability may change over time.

2. Eligibility

You must be at least 16 years of age to use TyLinks VPN. By registering, you represent that you meet this requirement. If you are using the service on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

3. Account Registration

To use TyLinks VPN you must create an account with a valid email address. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately at admin@tylinks.com if you suspect unauthorised access.

Accounts are personal and non-transferable. You may not share your VPN configuration files or account access with others unless you have purchased a plan that explicitly permits multiple devices.

4. Acceptable Use

You agree to use TyLinks VPN only for lawful purposes. You must not use the service to:

• Engage in any activity that violates applicable local, national, or international law or regulation.
• Transmit, distribute, or store material that infringes third-party intellectual property rights.
• Conduct port scanning, network probing, or vulnerability scanning of third-party systems without authorisation.
• Send spam, unsolicited bulk email, or engage in any form of mass marketing without recipient consent.
• Launch denial-of-service (DoS/DDoS) attacks or participate in botnets.
• Distribute malware, ransomware, spyware, or any other malicious software.
• Attempt to access systems or data you are not authorised to access.
• Circumvent technical measures of third-party services in violation of their terms.
• Engage in any activity that could damage the reputation, infrastructure, or service of TyLinks VPN.

Violation of this acceptable use policy may result in immediate account suspension or termination without refund.

5. Subscriptions and Billing

TyLinks VPN is offered on a subscription basis. The following billing terms apply:

• Trial period: New accounts receive a 3-day free trial where available. No credit card is required during the trial.
• Subscription plans: Paid plans are billed in advance on a monthly or annual basis as selected.
• Automatic renewal: Subscriptions renew automatically at the end of each billing period unless cancelled.
• Price changes: We will give at least 30 days' notice of any price increase before it takes effect.
• Payment processing: All payments are processed by Stripe. By subscribing you also agree to Stripe's terms of service.

6. Cancellation and Refunds

You may cancel your subscription at any time by contacting admin@tylinks.com. Upon cancellation:

• Your access will remain active until the end of the current billing period.
• No partial refunds are issued for unused time within a billing period, except where required by law.
• If you experience a technical issue that renders the service completely unusable and we cannot resolve it within 72 hours, you may request a pro-rated refund for the affected period.

7. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. We are not liable for any damages arising from service downtime, interruptions, or unavailability.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

8. Intellectual Property

All content, branding, software, and materials provided by TyLinks VPN remain our intellectual property or that of our licensors. You may not copy, modify, distribute, or create derivative works without our written permission.

WireGuard® is a registered trademark of Jason A. Donenfeld. Its use here refers to the open-source protocol.

9. Privacy

Your use of TyLinks VPN is also governed by our Privacy Policy, which is incorporated into these terms by reference. By using the service you consent to the data practices described therein.

10. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that: (a) the service will meet your specific requirements; (b) the service will be uninterrupted, timely, secure, or error-free; (c) the results obtained from use of the service will be accurate or reliable.

11. Limitation of Liability

To the maximum extent permitted by applicable law, TyLinks VPN shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the service.

Our total cumulative liability to you for all claims arising from or related to the service shall not exceed the amount you paid us in the 3 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless TyLinks VPN and its operators from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of the service; (b) your violation of these terms; or (c) your violation of any third-party rights.

13. Termination

We may suspend or terminate your account at any time if you violate these terms, engage in fraudulent activity, or if we are required to do so by law. Upon termination, your right to use the service ceases immediately. Sections 8, 10, 11, and 12 survive termination.

14. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes shall be subject to binding arbitration or the courts of the jurisdiction in which TyLinks VPN operates.

15. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.
